FAQs

What is business insolvency?

Business insolvency is a result of a company being unable to pay its debts that are due or when it has more liabilities than assets. If you’re struggling to meet financial obligations as a business, then it’s likely you’ll go through an insolvency process leading to administration or liquidation, depending on the circumstances.

If you are unable to pay your debts, or you owe more than you own, we can help with financial support to repay your creditors, managing finances and administration should it come to this. Coots & Boots, your dedicated insolvency consultant, is your advisor when you’re experiencing financial distress. We’re your insolvency helpline, supporting you every step of the way.

Is insolvency the same as bankruptcy?

No. Insolvency is financial distress; bankruptcy is a legal process for individuals. Companies don’t go bankrupt—they may enter liquidation, administration, or reach a compromise with their creditors via a CVA or a negotiated informal arrangement.

What happens to my company’s debt when it goes insolvent?

If a business becomes insolvent and is liquidated, any remaining debts are written off as you have legally declared yourself unable to pay. In the case where an individual, director or a business has acted as a personal guarantee, directors will be liable to pay off these debts.

Is insolvency the same as liquidation?

Liquidation can be an outcome of insolvency; they are not the same, but are related. Insolvency means that you are unable to pay your debts, and liquidation is the process of closing a company to pay off owed money. An insolvency Practitioner like us can help with both.
